Charged with a Felony?
Drug offenses can be serious. Recently, many elected officials have taken a zero tolerance approach with many drug offenses. This has led to the laws of Pennsylvania harshly punishing certain drug offenses. Substances such as cocaine, heroin, and methamphetamine may carry mandatory minimum sentences, especially if Commonwealth charges “intent to distribute.”
You may have a right to a Carroll Hearing where we can argue whether it was our client’s intent to distribute the substance or not. This can have an effect on the charges our clients are facing and can drastically reduce the sentence our client is facing.
First Time Drug Offender?
It is important that you speak with an attorney that handles Drug Offenses so that all options are explored. First time offenders may be eligible for Probation Without Verdict or the Accelerated Rehabilitative Disposition Program.
Depending on the facts of the case, either option may be available. These options are available for first time offenders and are designed to minimize what impact drug charges have on those accused. It is best to address these issues early in your case.
Small Amount of Marijuana?
Just because Marijuana is legal for certain uses in Pennsylvania does not mean that anyone can possess it. Despite recent progress, Marijuana is generally still illegal to possess and law enforcement continues to pursue Marijuana related charges. It is also illegal to possess items used to smoke Marijuana, such as pipes and bongs.
