The crash occurred around 6:15 a.m. The accident occurred when a wrong-way driver collided with a vehicle traveling in the Westbound lane of Route 22. Police are still investigating the incident. An autopsy is to be conducted and the Police are hopeful that it will help guide their investigation.
For an attorney, an autopsy can be extremely helpful in determining what happened. Many people mistakenly believe that an autopsy is performed in every case where there is a fatality. Watching TV, we all think that autopsies are common practice. This is not true. There are typically only a handful of times when an autopsy is actually performed.
Generally, the cause of death is a determination made by a treating physician in a hospital. When there is no suspicious activity or question to the cause of death, the Coroner typically accepts the doctor’s determination and no autopsy is performed. However, when no autopsy is performed, evidence may be lost.
Some of the most difficult conversations our attorneys have are conversations with clients asking whether or not they should seek an autopsy. If the Coroner does not order one, then the family of the decedent can order an autopsy be performed. Autopsies are invasive and it is not a decision to make lightly. But, in certain cases, an autopsy may be necessary. Sometimes, the cause of death that is determined by the treating physician is wrong. Other times, the nature of the injuries and trauma are not fully understood. Before making a decision whether or not to have an autopsy performed after a car accident that results in a fatality, seeking the advice of an attorney is critical.
