Car accidents that result in deaths are tragic. These cases can be complicated and are understandably emotional for those involved. These cases become even more complicated when an individual who may bring a Wrongful Death claim is also injured in the car accident and have a claim of their own.
A Wrongful Death claim can be brought when someone is killed as a result of negligence. These claims are brought by the deceased person’s family; including their spouse, children, or parents. In a Wrongful Death case, the family is seeking compensation for the loss they experienced.
If a family member was also injured in the accident, then they also have their own bodily injury claim. Bodily Injury claims compensate injured parties for their own physical injuries. So, not only is that person dealing with the loss of a loved one, but they are also dealing with the wrongful death claim, their own injuries, AND their own bodily injury claim.
