A first offense DUI in Pennsylvania is an ungraded misdemeanor. But the penalties change with what tier a DUI is classified as. When I say “Tier,” I’m talking about how much alcohol was in your blood or breath or whether or not there were drugs involved.
Depending on the tier, a First offense DUI can be punished from 6 months probation to six months in jail. There are mandatory sentences of 48 hours incarceration for a second tier DUI and 72 hours for a third tier. A fine can range from $300 to $5,000.00.
It’s a good idea to speak with an attorney that handles DUIs because you may have a defense, you may be eligible for a diversionary program, or, if you have to plead guilty, you may be able to avoid incarceration and be placed on house arrest instead.
