Often, when a pedestrian is hit by a car, the driver is typically at fault. These accidents are common in shopping plazas, gas stations, and in neighborhoods where drivers should expect to encounter pedestrians on foot. In these cases, we should expect drivers to take additional precautions when they know that a pedestrian may be nearby.
When our firm handles cases where pedestrians are hit by cars, we make every effort to preserve evidence. We do this because we prepare every case as if it will go to trial. We personally go to the scene of the accident, we speak with the investigating police department, and we search to find out whether there is any available video surveillance of the incident. What’s difficult is that the pedestrian likely did not see the car approaching. So, making these efforts to discover and preserve evidence can be the difference between winning or losing at trial.
