In general, inherited property is supposed to be protected under the Divorce Code. However, there are exceptions to that rule, and you will need to consult with competent legal counsel to assess each situation.
If a person is contemplating divorce and stands to inherit property, that person should consult with an attorney prior to getting the inheritance so that appropriate financial planning can help to protect that person’s inheritance from becoming marital property that would be subject to equitable distribution in the divorce case.
