In a divorce, in Pennsylvania, retirements can be marital property.
If a retirement account was earned during the marriage, then it can certainly be looked at. Even if a retirement account was earned before the marriage, some portion of it could be marital property, and so we have to at least discuss that in each case. That is a question that we ask at the initial consultation with our new divorce clients.
