An uncontested divorce simply means that the parties agree to be divorced. In the simplest uncontested divorce, with no other complicating factors, if all goes well, then a divorce can often go through in approximately four months or so—the law says 90 days, but it takes a couple weeks on each end to process the paperwork.
A contested divorce means that something is not simple—for example, one spouse doesn’t want to be divorced, or the distribution of assets is contested. Many cases start out as being contested, but with good lawyering, they can be worked out and eventually processed through a Marriage Settlement Agreement and a consensual entry of a Divorce Decree.
