A party can request an emergency custody order in Pennsylvania if a child is at risk of harm if the Court does not issue an emergency order.
Notice must still be provided to the responding party, and the Court will likely request some proof that the allegations set forth in the emergency petition are actually true and not just the attempt of one party to position himself or herself better in the custody action.
If you have questions about emergency custody, you should reach out to an experienced family law attorney.
