Mediation is a form of Alternative Dispute Resolution. By Alternative, I mean it is an alternative to having your legal case resolved by a Judge or Jury in a public proceeding.
Its distinct advantage is that it can be resolved privately, by consent amongst the parties, and absent the risk and inordinate expense of litigation through the courts.
Mediation requires the parties to mutually agree upon the selection of, what is typically a private attorney, to act as a neutral intermediary and facilitate negotiations amongst the parties.
The mediation is an informal process, usually scheduled in a private law office, and gives the parties the opportunity to air their grievances either face to face or in separate rooms.
The goal of mediation is a private resolution of the claims, memorialized in a settlement agreement, that would serve to end the legal dispute.
